Pskov city court on 8 November sentenced three former guards of the order and the leader of the regional branch of the Fund “City without drugs” Konstantin Vilkovo. They were convicted of criminal negligence and abuse of power, resulting in the death of a woman during a RAID. The corpse of the attackers hid in the woods, and destroyed evidence.
Russian Themis has appointed former police officer Roman Cansino a penalty of two years imprisonment with a probation period of two years. His former colleague Alexei Fedotov is sentenced to 2,5 years of imprisonment conditionally. As a former employee of the Ministry of internal Affairs Irina Tsareva got off with six months of corrective works with deduction of 10 percent of earnings. However, from this extremely mild sentence, the court freed the defendants, releasing them under the Amnesty declared in honor of the 70th anniversary of the Victory, says “Pskov information Agency”.
Constantine Vilkovo appointed 1,5 years of imprisonment conditionally, but also announced an Amnesty.
As follows from the materials of the criminal case, the police together with activists of “the City without drugs” staged joint raids on drug dens and drug trade. December 19, 2014 during another RAID in one of narcobrothels police arrested Oksana Kazimirovskii.
The court later noted that Fedotov and Konshin, knowing that Kazimirovskii could keep drugs in the mouth, ran to her, threw him on the ground and used her handcuffs. While Kazimirovskii swallowed plastic package with narcotic substance and choked: the parcel closed the lumen of the larynx. Because the woman’s hands were restrained with handcuffs, to pull the package from his mouth she could not. And nobody was going to help her. Within a few minutes she died from mechanical asphyxia.
Police at first thought Kazimirovskii faking a swoon. They took the lifeless body to the pharmacy, bought ammonia and was trying to put Oksana in a sense. Realizing that the woman died, the guards decided to get rid of the corpse.
Kazimirovskii moved to the house Konshin, who was key to the handcuffs. Further Fedotov, Konshin and Vilkov entered into a criminal conspiracy. The court considered that Tsarev was not aware of the intentions of the colleagues, although investigators believe the reverse: Irina remained in the city, providing associates with an alibi (cell phones men also were at the policewoman, then it was impossible to track their movement).
The attackers took the corpse to the forest near the village of Vasilievo of palkinskiy district, and then got rid of other evidence: spent dry cleaning the interior of the car, which carried the corpse and destroyed clothes, which at that time were partners in crime.
Body Oksana Kazimirovskii was discovered quite quickly – December 23, 2014. Subsequently managed to establish the identity of the alleged killers.
During the preliminary investigation, Konstantin Vilkov has repeatedly ignored calls for questioning, and then another, and helped one of the suspects to move to another region. Eventually the activist was taken into custody, but then replaced it a measure of restraint on house arrest, writes “Komsomolskaya Pravda”.
Police Fedotov and Konshin found guilty under part 1 of article 286 (“Excess of powers of office, entailed substantial violation of rights and legitimate interests of citizens”), and their colleague Tsarev – under article 293 (“the Negligence”) the criminal code of the Russian Federation. Vilkovo was charged with part 5 of article 33 and part 1 of article 286 of the criminal code of Russian Federation (“Complicity in abuse of office”).
“As a result of illegal actions of police officers, with the active assistance Vilkova rights were violated Kazimirovskii and her relatives, the right to private property, the right to burial. There was also a breach protected interests of society and the state,” said the court.
At the hearing, it was emphasized that such behavior of police officers creates disrespect for legal norms and discreditied the authority of law enforcement.
However, the court dropped the charges under paragraph “a, b” part 3 article 286 of the criminal code (“abuse of authority with use of weapons and special means, with causing of heavy consequences”) brought against Fedotov and Konshin. Thus, the Russian Themis not see a direct causal link between the actions of the police and the death of Oksana Kazimirovskii.
At sentencing were considered softening circumstances: positive characteristics of the accused, lack of criminal record, a partial confession, the apology to the injured party and compensation, the presence of dependent children, attendance Fedotov guilt and the imminent birth of a child Vilkova.
The verdict can be appealed within 10 days in the Pskov regional court.
