In Tambov, the judge received a bribe of 200 thousand rubles, sentenced to 7.5 years of strict regime
In the Tambov region the court has pronounced a sentence already to the former judge Sergei Suchkov, who was found guilty of bribery. The judge received hundreds of thousands of rubles for sentencing in the interests of the company-debtor.
The decision of the court Sergey Suchkov will be imprisoned for 7.5 years. To serve his sentence he will be in the correctional colony of strict regime. Besides, the condemned is deprived the right to occupy positions in the public service for six years, reports the official website of the regional Department of the RF IC.
Determined that March 1, 2016 judge of the Arbitration court of the Tambov region Sergey Suchkov has issued a ruling on restoration of term for filing of a writ of execution to recover from one construction company (JSC “Zhilstroy”) in favor of another (“su-5 Zhilstroy”) in cash in the amount of about eight million rubles. Two weeks later, during a conversation with a representative of the organisation-the debtor, the judge offered him assistance in delaying foreclosure. For this “service” the judge asked me to give him 200 thousand rubles.
Having received the consent of Knots the next day made that determination. A week later, during a meeting between the judge and the representative of the company-the debtor it is reported that at the same time made the decision to deny the claim of the claimant, having estimated the “additional services” in 100 thousand roubles. The second reward was supposed to be transferred to the judge later.
“Upon receipt of the originally agreed amount in the amount of 200 thousand rubles, the judge was detained by employees of regional government of FSB of Russia”, – said in a press release.
In may 2016 qualification Collegium of judges of Tambov region deprived Suchkov from office of a judge “in connection with the Commission of the disciplinary misconduct”. In September 2016 Higher qualification Collegium of judges of the Russian Federation, having considered representation of Chairman SK the Russian Federation has consented to the initiation of criminal proceedings against a judge.
The outcome of the proceedings Suchkova was found guilty under paragraph “C” of part 5 of article 290 (“bribe reception”), part 3 of article 30, part 4 of article 290 (“Attempt at bribe reception”) the criminal code of the Russian Federation.
It is noteworthy that a bribe to a judge of Knots extorted from the management of JSC “Zhilstroy”, which in 2011 lost a court battle. At the end of this process the company and ordered to pay a multimillion-dollar debt, and this decision carried the same judge of Knots.
The companies JSC “Zhilstroy”, LLC “su-5 Zhilstroy” had businessman Vladimir Kotenko, at different times, the former co-owner and Manager of these companies. “Zhilstroy” was the General contractor on one of the objects of the SU-5, and at the end of the works the defendant “had the duty” in the amount of 8.1 million rubles, wrote earlier “Kommersant”.
After filing a lawsuit “Zhilstroy” repaid part of the sum, and then the parties requested referral of the case to arbitration, but not all actors, including the former Director and co-owner SU-5, Sergey Rumyantsev, agreed. In the end, the judge of Knots found for “Zhilstroy” duty of 7.5 million rubles and ruled it. The defendant tried to challenge the decision until the appeal, but lost, and since 2013, the trial was discontinued.
However, in February 2016, in the case entered the Moscow merkato, OOO, took the debt from the SU-5 (self-SU-5 last year was in liquidation). “Mercato” is successfully petitioned for restoration of the term for the issuance of writs for recovery of old debt.
Sergey Suchkov was born on 8 September 1967, in the village of Bogoslovka Tambov district, Tambov region. In 1991, he graduated from the history Department of Tambov of the order “badge of Honor” state pedagogical Institute, informs “Sadact.ru”.
In 1997, Suchkov graduated from the Moscow state law Academy. Seven years later, by the decree of Russian President Vladimir Putin, he was appointed judge of the Arbitration court of Tambov region.
Sergey Suchkov was the third class qualification of a judge. In the judiciary, he worked for almost 20 years, earning the gratitude of the Chairman of the Arbitration court of Tambov region.
