Commenting on the letter from Roskomnadzor, the author of the play Sergey Fokin said that he does not understand the essence of the claims of Roskomnadzor: “Roskomnadzor is clearly a problem with enforcement. Media law I had violated the law on disclosure of personal data play is impossible to violate the law about the insult of honour and dignity? – I don’t know, but the court has not yet filed… I don’t understand what rate of the law I have violated.”
As the author notes, his play “a fantasy on the theme of the lives of real people as they would do in a similar situation.”
Fokin reminded that there are hundreds of works that use true names.
“Lenin in October” looked? Or take, for example, Zagara, Akunin, Radzinsky. They wrote books and plays, where he used real names. I wrote this story in the hope that someone from the Directors will like it and someone will take that it supply. Unfortunately, those to whom I showed it, they say that none of our theaters this material will not take to the production. I understand that this would be a great heroism,” says the author.
This is not the first case when officials are trying to declare the names of the personal data protected by law.
A few years ago the EA (now former adviser) to the President of Russia on combating corruption Sergei Dubik felt that portal “Civil control” violated the law on personal data, published in the material of his title and last name.
In 2009, the Prosecutor asked the ex-investigator RF IC Gulnara Mustafina, whose name and position were named in the article of the newspaper “Moscow news”. Against the Agency “RIA Novosti” and the chief editor Svetlana Mironyuk was instituted administrative proceedings. But in 2012, the court dismissed these cases, holding that the use in the publications of information about the names and positions of officials is not a violation of the law.
The fact is that according to the Federal law “On information, information technologies and protection of information” that officials probably do not read the information to which access is not restricted, are public information.
