Basmanny court of Moscow has translated the 36th defendant in the “Bolotnaya case” Maxim Panfilov, 31-year-old chef from Astrakhan with Tourette syndrome, a recognized expert of the Serbsky Institute’s insane, in a psychiatric hospital at the SIZO No. 2 (“Butyrka”) on the street Novoslobodskaya, 45, reports RIA “Novosti”.
“Forced transfer. in a medical organization providing psychiatric care in certain stationary conditions”, the term previously chosen measure of restraint in form of arrest, petitioned the investigation. The investigator recalled that according to experts, Panfilov suffers from mental illness and are declared insane.
Now the accused, according to his lawyer, Sergei Panchenko, is in the hospital in Butyrka prison. “Panfilov on the orders of the head of the detention center have already been transferred to a hospital. That is the consequence asks to translate it where it already is”, – the lawyer explained.
Panfilov himself was asked to “quickly transfer him to a hospital from prison”: “This is not a hospital, it’s a prison. Do not treat me there, I don’t want to be there, there pills is not given, and does not give,” he complained.
The TV channel “Rain” Panchenko said that the defence considers the decision “absolutely unlawful and unfounded, because this order can be placed in a psychiatric hospital only persons who have committed criminal acts”.
According to counsel, the investigation uses a “safety scheme”, since October 5, the Presidium of the Supreme court declared illegal the detention and the extension of arrests of two defendants in Bolotnaya case – Ilya Gushchina and Artem Savelova. “In my opinion, they do this to insure and not to let go of Panfilov in any way,” he explained.
The investigation against Maxim Panfilov was completed, the defense and the accused has started acquaintance with materials. Since he was declared insane, his legal representative in court is the mother. As was reported earlier, Panfilova is a chronic disease – Tourette’s syndrome (disorder of CNS characterized by involuntary nervous tics and sometimes speaking ill of foul language).
According to investigators, a resident of Astrakhan Panfilov, a graduate of a culinary school, specially came to Moscow to participate on may 6, 2012 opposition rally on Bolotnaya square. The investigation period in this case extended to March 6, reports TASS.
Maxim Panfilov became the 36th of the account involved in the case. It, according to investigators, identified in the video, where he allegedly rips off the helmet from the employee of the Moscow OMON. Panfilova was detained in April and was delivered from Astrakhan to Moscow, where he was accused of obstructing the arrest of “rebellious citizens” in an attempt to disrupt the helmet. He nonetheless admitted that he had been at the scene, but the damage to law enforcement is not caused because his helmet was not buckled.
The so-called “Bolotnaya case” were initiated after collisions of participants agreed with the authorities “March of millions” and police on Bolotnaya square on 6 may 2012. Then detained about 400 protesters. A criminal case was opened under article 212 of the criminal code “Mass riots” and article 318 of the criminal code “Violence against representatives of the authorities”. To criminal prosecution in this case had attracted more than 30 people.
Now under remand custody is Dmitry Buchenkov. Another four are serving sentences – Ivan Sciences, Dmitry Echevsky, Sergei Udaltsov and Leonid Razvozzhayev.
