The Moscow city court dismissed a cassation appeal against the verdict Ildar Dadina, the first in the history of the Russian justice system convicted for repeated violation of the rules of holding rallies. A complaint in August this year was sent to the office of the Commissioner for human rights in the Russian Federation Tatiana Moskalkova.
According to information published on the official website of the Moscow city court, the appeal was registered on 3 Aug, 31, the case has been reclaimed, September 14 – received and 30-th of the plaintiffs were denied the complaint on the verdict of the Basmanny district court of the capital.
“And this despite the fact that the appeal was signed by our Ombudsman Tatiana Moskalkova. This is despite the fact that the article spoke of members of the presidential Council on human rights. This is in spite of the participation of Henry Reznika. In the end, despite the fact that the case at 212.1 to Ildar – sucked from the finger, is considered with a huge number of violations”, – commented on the decision of Moscow city court, the activist’s wife Anastasia Zotova.
The protection of the Dading sent a complaint to the European court of human rights (ECHR). According to the lawyer Ksenia Kostromina, listed in the complaint is admitted by the authorities of the Russian Federation of violation of articles of the European Convention on human rights: the right to freedom of Assembly and Association (article 11), right to a fair trial (article 6), the right not to be tried or punished twice (part 1 of article 4 of Protocol N7).
August 5 office of the Commissioner for human rights in the Russian Federation Tatiana Moskalkova filed a cassation appeal against the verdict to the activist, August 11, his lawyers sent a complaint to the constitutional court of the Russian Federation. The complaint disputes article of the criminal code, for which he was sentenced to three years in violation of numerous provisions of the Constitution, in particular the right to peaceful Assembly, to freedom of expression and the right not to be convicted repeatedly for one and the same act.
The judge of Basmanny court of Moscow Natalya Dudar 7 December 2015 recognized Dading guilty of violating article 212.1 of the Criminal code provides for liability for repeated violation of the rules of holding rallies, and sentenced to three years in a General regime colony, although the prosecution had asked only for two years. March 31, the Moscow city court has mitigated the sentence to activist for six months.
According to the materials of the case, Dading has been repeatedly brought to administrative responsibility for participation in opposition rallies – four in 2014. Dading remains the only convicted under article 212.1 of the criminal code after her appearance in the new edition of the Criminal code of the Russian Federation in the summer of 2014.
