The Ministry of national defence of Poland handed over to the Prosecutor’s office supplementary material to the statement from March of 2017 to the President of the European Council and former Prime Minister Donald Tusk. Earlier it was reported that the policy is suspected that it is to the detriment of the Polish side signed an agreement on carrying out in Russia of the repair of the presidential plane Tu-154, which later crashed near Smolensk in 2010. Now the former Prime Minister also accused that after the accident he neglected the Polish-Russian agreement of 1993, which gave the parties equal rights in the investigation of the tragedy.

In a communication dated 10 October on the website of the Polish Ministry of defense says that Tusk committed a “crime against Poland” was to “move away from the Polish-Russian agreement of 1993, Poland, guaranteeing equal rights, and the conclusion of an agreement with the Russian Federation on investigation of the Smolensk disaster, based on Annex 13 of the Chicago Convention”.

Directed to the Prosecutor the additional materials include information about the three telephone conversations on 10 April 2010 (the day of the disaster. – Approx. that Tusk spent with who was then Prime Minister of the Russian Federation Vladimir Putin and former President Dmitry Medvedev. The documents lists the persons that accompanied the negotiations and knew about them.

The materials contain a chronology of decisions about how to investigate the catastrophe, which took Tusk, who was then the Minister of defence of Poland Bogdan Klich, who, “contrary to the legitimate duties until April 15, 2010 not convened the state Commission on investigation of accidents, preventing the legitimate actions of Polish experts in Smolensk, Minister of infrastructure Sezari Grabaric, who contributed to the investigation in accordance with Annex 13, Edmund Klich, who, as Chairman of the state Commission on aircraft accident investigation, received from the hands of the Prime Minister of Russia Vladimir Putin the post of member of the Russian Commission [to investigate the accident]”.

At the same time, the parties will provide access to the necessary documents in accordance with the applicable rules on the protection of state secrets.”

The Ministry said that the bilateral agreement guaranteed the equality of the parties and cooperation in the investigation. From Poland the relevant expertise possessed by the Commission on aircraft accident investigation, which was to cooperate with the relevant authority in Russia. The document guaranteed shared access to documents, and in the case of its application would help to avoid failure in response to the request of Poland on the provision of evidence. But the rejection of the application of the agreement gave Russia a Central role in the investigation of the disaster.

Also in mid-March of this year, the Polish Prosecutor’s office called Tusk for questioning as a witness in the case against former employees of the Polish military intelligence Service, accused of contacts with Russian FSB without the corresponding order in 2010. Presumably, the prisoner was in April 2010 after the crash of the presidential “Tu-154M” agreement between the SVK and the FSB concerning the parties ‘ cooperation in the fight against various threats.

In addition, in October 2016, Macierewicz caught Tusk that on the day of the plane crash near Smolensk on 10 April 2010 the “secret” meeting with Putin, who was then Prime Minister, and Dmitry Medvedev, who was President of Russia. Poland has the video recording of this meeting.

Macarevich, claimed that Tusk didn’t tell anyone about this meeting. Also, according to him, the Russian side then presented the Polish premiere of the version of the accident, did not comply with the conclusions announced later by the Interstate aviation Committee and the Board of the ex-Minister of internal Affairs of Poland hedgehogs Miller.

The plane crash Tu-154 near Smolensk occurred on April 10, 2010. In the end, killing all 96 people aboard including Polish President Lech Kaczynski and his wife. These findings agreed by the party of Jaroslaw Kaczynski’s “Law and justice”. After coming to power at the end of the next parliamentary elections in October 2015, its representatives started the procedure to revise the results of the work of experts, forming a new Commission to investigate the accident.
